TV ONE “LIVE THE DREAM” ESSAY CONTEST OFFICIAL RULES
 

1.    ELIGIBILITY:  The TV One “Live the Dream” Essay Contest (“Contest”) is open to currently enrolled high school seniors who are legal residents of the 50 United States or the District of Columbia.  NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING.   Employees, talent, contractors, advertising agencies, promotional suppliers, officers, directors, and members of TV One, LLC (TV One, LLC, the "Sponsor"), its subsidiaries, investors, participating cable providers including local ad sales systems, participating local advertisers, and the employees, officers, directors or immediate family members (spouses and parents, children and siblings and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals (collectively “Contest Entities”) are not eligible.  Eligibility may be verified by Sponsor at any time.  Any determinations of eligibility will be made by the Sponsor whose decisions are final.  All federal, state, local and municipal laws and regulations apply.  Void where prohibited.

2.    HOW TO ENTER:  From February 1, 2008 through March 31, 2008, the Sponsor will be conducting an essay contest encouraging students to watch the “MLK:  A Dream Deferred” television program as broadcast on the TV One cable network and to then create an essay answering the question “Are we living the Dream today?” .  Each entrant must submit an essay written in English that numbers 500 words or less.  Entrants may enter online by accessing www.tvoneonline.com/ourhistory, completing the online entry form and submitting the Contest essay (such submission shall be considered an “Entry”).  Entries must be received by Sponsor’s server by 11:59 PM Eastern Time on March 31, 2008.  If an Entry numbers more than the maximum 500 words allowed, it will be disqualified.  Limit only one submission per email address.  The identity of an online entrant will be deemed the holder of the e-mail address from which an Entry was submitted.

Entry must be the entrant’s original creation, executed solely by the entrant and may not have been published previously or won any other award, and the right to submit it must not be restricted.  Entry cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights including but not limited to copyrights or trademarks. False or deceptive Entries or acts will render an entrant ineligible.  Submissions that the judges and/or the Sponsor determine, in the sole discretion of either party, contain profane or inappropriate content will not be reviewed and the entrants submitting same will be disqualified.  Entry materials become property of Sponsor.  Sponsor is under no obligation to correspond about Entries nor will Entries be acknowledged or returned.

Entrants grant the Sponsor all rights of ownership, reproduction, and use of Entries for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit Entries, for commercial or non-commercial use, and without compensation to the entrant.  By entering the Contest, each entrant waives any and all rights he or she may have to the submission.  To the extent the entrant has any rights in the submission, the entrant assigns all such rights to the Sponsor by entering the Contest.

3.    JUDGING:  All eligible Entries received will be judged by an independent, qualified judging organization (the “Contest Administrator”), and will be a assigned numerical point value based on the following judging criteria:  relevance to the “MLK:  A Dream Deferred” program, originality/creativity, clarity of expression, and grammar (collectively or individually, the “Criteria”) with equal weight being given to each Criteria element.  The Grand Prize (as defined below) winning Entry will be the one that receives the highest aggregate point score.

After the Grand Prize (as defined below) winner has been determined, the Contest Administrator will separate the remaining Entries according to the market area in which the entrant resides.  Entries submitted by entrants who reside in the market area of a participating cable operator will be judged again by the Contest Administrator using the Criteria to determine local First Prize winners.  For each market area of a participating cable operator, a First Prize (as defined below) winning Entry will be the Entry that receives the highest aggregate point score. In the event that no eligible Entries are received in a particular participating cable operator market area, no First Prize will be awarded in that participating cable operator market.

In case of a tie for a First Prize in a market area of a participating cable operator, the tie will be broken by comparing the originality/creativity score value of each tied Entry.  The Entry with the highest originality/creativity score will be deemed the First Prize winner.  In the event that a tie still exists, the Entry with the earliest submission date and time (Eastern Time, as assigned by the Sponsor’s server) will be deemed the First Prize winner.  Odds of winning depend on the number of eligible entries received.

4.    PRIZES:  One (1) Grand Prize:  $2,500.00 to be earmarked as a college scholarship.  One (1) Local First Prize per participating market area:  $500.00 to be earmarked as a college scholarship.  Prizes will be awarded as a check made payable to the winner and will be intended to help pay for education-related expenses at an institution of higher education.  Prizes are non-transferable and no substitution will be made.  Winner is responsible for all taxes and fees associated with prize receipt and/or use.

5.    NOTIFICATION:  Winners will be notified by phone, email, postal mail and/or express mail at Sponsor’s sole discretion on or about April 30, 2008.  Inability to contact a winner or the return of any prize notification as undeliverable will result in the prize being forfeited and awarded to an alternate winner.  The Grand Prize and First Prize winners will be required to execute an affidavit of eligibility, and release of liability which must be returned within 10 days of prize notification.   Additionally, the Grand Prize winner will be required to execute a  publicity release (where legal), which also must be returned within 10 days of prize notification.  If the winner is a minor, parent or legal guardian must ratify and sign any and all documents required of winner.  In the event of noncompliance with these Official Rules (including timely return of signed documents), or if a winner cannot be contacted, cannot accept prize, or if prize or prize notification is returned as undeliverable, the prize will be forfeited and an alternate winner will be selected.

6.    GENERAL:  By participating, entrants agree: [a] to these rules and decisions of Sponsor and Administrator, which shall be final in all respects relating to the Contest; and [b] to release, discharge and hold harmless Contest Entities from any and all injuries, liability, losses and damages of any kind resulting from their participating in the Contest or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy. Entrants agree to grant Sponsor: [a] all rights of ownership, reproduction and use of Contest Entry for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-fee, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit Entries, for commercial or non-commercial use; and if a winner, [b] to permit Contest Entities to use his or her name, photograph, likeness, Contest Entry, biographical information, voice, voice likeness, and city and state address for advertising, publicity and promotional purposes in all media, in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request.  Contest Entities are not responsible for and shall not be liable for [a] any telecast or cable malfunctions, human error, satellite transmission failures, or delayed telecasts or preemption of or the failure of a cable affiliate to televise TV One in all or any parts of the country; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind, including without limitation server malfunction or by any error (human or otherwise) which may occur in the processing of Entries; [c] lost, late, misdirected, mutilated, incorrect, incomplete or illegible Entries; or [d] any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted.  By entering the Contest, entrants agree that [a] any and all disputes, claims and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resorting to any form of class action; [b] any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; and [c] under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.  Such entrants further acknowledge and agree that in any cause of action, such entrant(s) will not be permitted to obtain any award for, and hereby waives all rights to claim, punitive, incidental or consequential damages and other damages, other than for actual out-of-pocket expenses for entering and participating in the Contest.  Sponsor reserves the right in its sole discretion to cancel, modify or suspend the Contest or any portion thereof should viruses, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the promotion or to disqualify any entrant if his or her fraud or misconduct affects the integrity of the Contest, in which case prizes will be awarded from the collection of all eligible, non-suspect Entries received prior to the event requiring such cancellation.  CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Internet Entry must be made by the entrant only at the authorized Web site address. Entries may not be made by any other individual or any entity, and/or originate at any other Internet Web site or e-mail address.  Entries generated by script, macro or other automated means are void.   All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsor, shall be governed by and construed in accordance with the laws of the State of Maryland, with jurisdiction and venue in Montgomery County, Maryland, and all claims must be resolved in the courts of Montgomery County, Maryland. The invalidity or unenforceability of any provision of these rules shall not affect the validity and unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.  The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor(s) (excepting compliance with applicable codes and regulations) or other force major event will not be considered a breach of these Official Rules.

7.    WINNER LIST:  For a list of winners, mail a self-addressed, stamped envelope to be received by May 31, 2008 to:  TV One “Live the Dream” Essay Contest Winner List, PMI Station, PO Box 750, Southbury, CT  06488-0750.
